Drink driver and passenger swapped seats

TWO men appeared at Airdrie Sheriff Court for sentencing after the car they were in failed to stop for police.

Jamie Higgins (24) from Victor Street and Kevin Brophy (23) from Jarvie Avenue, both Plains were in the car during the incident on November 25 last year.

Higgins was driving dangerously at excessive speed on Ballochney Road and Heatheryford Gardens in Plains. He drove in the wrong direction through two roundabouts and on the wrong side of the carriageway.

Police officers tried to stop him twice on Heatheryford Gardens and Beecraigs Way. Higgins, who was found to be over the drink drive alcohol limit with a breath reading of 40mg in 100ml of breath, attempted to pervert the course of justice by swapping seats with Brophy.

Brophy, who resisted arrest and struggled violently with officers when they attempted to arrest him, was fined £180 by Sheriff Frank Pierri.

Higgins who was also due to be sentenced for driving while disqualified and without insurance at Forest Street, Airdrie on November 12 this year, had his sentence deferred until December 21 for social work reports.
